DMCA Policy.
Overview
The International Cardistry Association respects the intellectual property rights of others and expects members of the Platform to do the same. This policy explains how to submit a copyright infringement notice regarding content on cardistry.org, and how a member may respond if their content is removed.
Designated Agent
The ICA has registered a Designated Agent with the U.S. Copyright Office under 17 U.S.C. § 512, as listed in the DMCA Designated Agent Directory. Notices of claimed infringement should be sent to adam@cardistry.org, or by mail to International Cardistry Association, Inc., 50-35 70th Avenue, Ridgewood, NY 11385, Attn: Designated Agent.
Filing a Notice
A valid notice of claimed infringement must be a written communication that includes: (1) a physical or electronic signature of the copyright owner or a person authorized to act on their behalf; (2) identification of the copyrighted work claimed to be infringed; (3) identification of the material claimed to be infringing, with enough detail for us to locate it on the Platform; (4) your contact information, including address, telephone number, and email address; (5) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and (6) a statement, made under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.
Our Response
Upon receiving a notice that substantially complies with these requirements, we will remove or disable access to the identified material and notify the member who uploaded it. We reserve the right to remove content that appears to infringe copyright even in the absence of a complete notice.
Counter-Notification
A member whose content was removed may submit a counter-notification if they believe the material was removed as a result of mistake or misidentification. A valid counter-notification must include: identification of the material and its location before removal; a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification; your contact information; and a statement consenting to the jurisdiction of the federal court in your district (or, if outside the United States, the Southern or Eastern District of New York) and that you will accept service of process from the person who filed the original notice.
Repeat Infringers
In appropriate circumstances, the ICA will terminate the accounts of members who are determined to be repeat infringers of the copyright rights of others.
